Agreement to these terms
By accessing our website at bookandread.org (or any successor site we operate), purchasing our printed recipe book, or enrolling in our Weekend Zoom recipe classes, you agree to these Terms & Conditions. If you do not agree, do not use the site, purchase products from us, or enroll in Zoom classes.
Who we are
“Book and Read,” “we,” “us,” and “our” refer to Book and Read LLC, a Wyoming limited liability company, with its principal office at 1021 E Lincolnway Suite 9468, Cheyenne, WY 82001, USA.
Changes
We may update these terms from time to time. The updated version will be posted on this page with a revised “Last updated” date. Your continued use of the website after changes become effective constitutes acceptance of the revised terms, except where applicable law requires additional consent.
Website eligibility and acceptable use
You agree to use the website only for lawful purposes and in a way that does not infringe the rights of others or restrict their use of the site. You agree not to attempt to gain unauthorized access to our systems, interfere with security features, scrape or harvest data in violation of these terms, or distribute malware, spam, or harmful code.
Physical cookbook
When you purchase our printed recipe book, you receive a physical copy for personal, non-commercial use unless we grant written permission for a different use. You may not copy, scan, redistribute, or resell the content in ways that infringe our intellectual property rights, except as permitted by applicable law (for example, fair use) or express written consent.
Product descriptions on our site are presented in good faith. Statements about the number of recipes or the scope of the collection describe the product in good faith and may vary by edition, printing, or update. We may change editions, cover design, or availability from time to time. If we materially change what is included, we will describe it on our site or at order. We do not warrant that every recipe will work perfectly in every kitchen environment.
Pricing and payment
Prices for our cookbook are listed in U.S. dollars (USD) unless we clearly state otherwise for a specific offer. Taxes, shipping, handling, duties, brokerage, or import fees may apply depending on your location (including, for shipments to Canada, charges described in our Shipping & Delivery Policy).
Cash on delivery. Unless we notify you otherwise for a particular order, you place your order through our website as described on our order page; payment is collected when your package is delivered (cash on delivery), in accordance with our Shipping & Delivery Policy and the carrier’s (UPS) procedures. You agree to have the correct payment available at delivery.
If we offer additional payment methods for a specific transaction in the future, we will describe them at the point of purchase, and any charge will be for the total amount we show you before you confirm.
Weekend Zoom recipe classes (membership)
We may offer live weekend recipe classes conducted online via Zoom, as described on our Zoom classes page (including the current monthly fee, currently USD $49.99 per month unless we state otherwise when you enroll).
Enrollment. You enroll by contacting us through the channels we specify (for example, our contact form, email, or phone). We will confirm availability, schedule, billing, and how you receive meeting links. Until we confirm enrollment and payment (if applicable), you are not guaranteed access.
Zoom platform. Classes use Zoom Video Communications, Inc. or its affiliates. You must comply with Zoom’s terms of service, acceptable use rules, and privacy policy. You are responsible for your Zoom account, device, internet connection, and any fees Zoom charges you. We are not responsible for Zoom service failures, security incidents on Zoom’s systems, or changes Zoom makes to its product.
Conduct and safety. You agree to participate respectfully and follow our reasonable instructions during sessions. Harassment, recording or redistributing our class content without permission, or unsafe behavior may result in removal from sessions or termination of membership without refund, where permitted by law. You participate in your own kitchen at your own risk; you are responsible for food safety, allergens, children, pets, and safe use of appliances and tools.
Schedule and changes. Session times and topics may change. We may cancel or reschedule a class for instructor availability, holidays, technical issues, or low enrollment. We will use reasonable efforts to notify enrolled members. We do not guarantee a minimum number of live sessions per month unless we expressly state that in writing for your enrollment.
Intellectual property. Materials and instruction we provide in Zoom classes (including verbal instruction, shared documents, and follow-up information we send) are protected by copyright and remain our property or our licensors’ property. You receive a personal, non-commercial license to use what we share for your own home cooking unless we grant broader rights in writing.
Cancellation and refunds. How you cancel membership and whether fees are refundable are explained in our Refund Policy. If mandatory consumer law in your jurisdiction gives you rights that cannot be waived, those rights apply.
Intellectual property
Unless otherwise noted, the website design, branding, text, graphics, and other materials we provide are owned by Book and Read LLC or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not use our marks or materials without prior written permission, except for limited personal viewing consistent with these terms.
User content
If you submit feedback, testimonials, or other content to us, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, and display that content for business purposes such as marketing and product improvement, unless we agree otherwise in writing. You represent that you have the rights to grant this license.
Disclaimer of warranties
Our website, physical products, and Weekend Zoom recipe classes are provided on an “as is” and “as available” basis, to the fullest extent permitted by law. We disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, except where implied warranties cannot be excluded for consumer goods under applicable law. We do not warrant that the site will be uninterrupted, error-free, or free of harmful components, or that any live class will occur on a specific date without rescheduling.
Limitation of liability
To the fullest extent permitted by applicable law, Book and Read LLC and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the website, our physical cookbook, or our Weekend Zoom recipe classes (including participation in your kitchen or use of Zoom’s platform), even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of or relating to these terms or your use of the site, products, or Zoom membership will not exceed the greater of (a) the amount you paid us for the product or service giving rise to the claim during the twelve (12) months before the claim, or (b) fifty U.S. dollars (USD $50), except where prohibited by law.
Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the maximum extent permitted.
Indemnity
You agree to defend, indemnify, and hold harmless Book and Read LLC from claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the website, your violation of these terms, or your violation of third-party rights.
Governing law and venue
These terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-law principles, except that this choice of law does not deprive you of the protection of mandatory consumer protection rules that apply to you in your country or state of residence and cannot be waived by contract.
Where applicable law allows the parties to agree on a forum, you and Book and Read LLC agree to submit to the jurisdiction of the state and federal courts located in Wyoming, and you consent to personal jurisdiction there for those claims. If a mandatory law requires a dispute to be heard in a different court, or does not permit an exclusive choice of Wyoming courts, that requirement applies.
Severability
If any provision of these terms is found invalid or unenforceable, the remaining provisions remain in full effect.
